Terms of Service

Welcome to PedalCrew! These Terms of Service ("Terms") govern your use of the PedalCrew mobile application ("App") and related services. By using PedalCrew, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using PedalCrew, you confirm that:

• You are at least 16 years of age.
• You have read and agree to these Terms and our Privacy Policy.
• You will comply with all applicable laws and regulations.

2. Account Registration

• You must sign in using your Google account.
• You are responsible for maintaining the security of your account.
• You are responsible for all activities that occur under your account.
• You must provide accurate information and keep it up to date.
• One account per person. Do not create multiple accounts.

3. Using PedalCrew

PedalCrew helps cyclists organize and join group rides. You may:

• Create and schedule group rides.
• Create Quick Beacons to find nearby riders.
• Join rides created by other users.
• Comment on and interact with ride activities.
• Earn points and badges for participation.

4. Acceptable Use

When using PedalCrew, you agree NOT to:

• Violate any laws or the rights of others.
• Harass, bully, threaten, or intimidate other users.
• Post false, misleading, or inappropriate content.
• Organize dangerous, illegal, or harmful activities.
• Upload malicious software or harmful content.
• Attempt to access other users' accounts or data.
• Use automated systems to access the service (bots, scrapers).
• Circumvent security features or access controls.

5. User Content

You retain ownership of content you create (ride titles, descriptions, comments, photos). By posting content, you grant PedalCrew a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content as necessary to operate the service.

You are solely responsible for your content. Do not post content that:

• You don't have the right to share.
• Is illegal, offensive, or harmful.
• Infringes intellectual property rights.
• Contains personal information of others without consent.

6. Safety & Responsibility

• Always wear appropriate safety gear (helmet, lights, etc.).
• Obey all traffic laws and regulations.
• Assess your own fitness and ability before joining rides.
• Check weather and road conditions.
• PedalCrew does not organize, lead, or supervise rides.
• Ride organizers are fellow users, not PedalCrew employees.

7. Third-Party Services

PedalCrew uses third-party services including:

• Google Firebase: Authentication, database, storage, notifications, and analytics.
• Google Sign-In: Account authentication.
• OpenStreetMap: Map display.

Your use of these services is subject to their respective terms and privacy policies.

8. Intellectual Property

PedalCrew and its original content (excluding user content), features, and functionality are owned by BiGi Development and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or reverse engineer the App without permission.

9. Disclaimer of Warranties

PedalCrew is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose.
• Accuracy, reliability, or completeness of information.
• Uninterrupted or error-free operation.
• Safety of rides organized through the App.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PedalCrew and its developer (BiGi Development) shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, or opportunities.
• Personal injury or property damage arising from rides or activities.
• Actions of other users.
• Service interruptions or data loss.

11. Indemnification

You agree to indemnify and hold harmless PedalCrew and BiGi Development from any claims, damages, losses, or expenses arising from your use of the App, your content, or your violation of these Terms.

12. Account Termination

• You may delete your account at any time via Settings → Delete account.
• We may suspend or terminate your account for violations of these Terms.
• Inactive accounts may be deleted after 2 years (with 30 days notice).
• Upon termination, your right to use the App ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated through the App or email. Continued use of PedalCrew after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Slovenia and the European Union. Any disputes shall be resolved in the courts of Slovenia, except where consumer protection laws provide otherwise.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
